NJ Advertising Rules: How to Stay in Compliance

Joel Neuenhaus ·

Are you playing the reverse lottery with your license? You probably don’t mean to put your livelihood at risk, but the NJ statute on Advertising Rules (11:5-6.1) for real estate agents can be overwhelming & hard to decipher.

To make things easier, we’ve broken it down into three simple rules of thumb you should follow, regardless of where or how you are advertising:

  • Your license type must appear after or under your name (e.g. salesperson, broker-salesperson, broker, referral agent or referral associate).

  • Your company name must be in larger print or displayed in a more prominent manner than your name.

  • The main office phone number must appear, and all phone numbers must be labeled.

Depending on the details, you may be subject to additional rules and we are not lawyers, so don’t rely on this alone. The best way to stay safe is to check any advertisements with your broker, legal counsel and / or the real estate commission, before publishing.
